The first statute is driving under the influence in violation of California Vehicle Code section 23152, subdivision (a). The second statute is driving with a blood alcohol concentration (BAC) of .08% or greater in violation of California Vehicle Code section 23152, subdivision (b). If a person is convicted of having violated either statute, they have lost their DUI case.
